Enforcing Your Tenancy Conditions
If you break any condition of your tenancy then we will tell you about it and ask you to comply with your tenancy conditions.
If you do not do so then we may take various measures that do not involve going to court to encourage you to comply with your tenancy conditions.
Non-legal Remedies
They include:
Legal Remedies
We may also use legal remedies to make you comply with your tenancy conditions, including:
In some circumstances we could also apply for an injunction to exclude you from your home.
Other possible actions
We could also ask for an order suspending or terminating any existing right to buy application.
Repossessing Your Home
If we feel it appropriate we can serve you with a notice that tells you we intend to seek repossession| of your home, normally after 28 days.
However there may be occasions when the anti-social behaviour is so serious that a 28 days notice may be unnecessary and we could act immediately.
If you still fail to comply with your tenancy conditions, we may apply to the court for a possession order. In very serious cases we will ask for immediate possession and evict you. In others we will ask for a suspended possession order giving you one last chance to comply with your tenancy conditions.
If you still fail to comply with your tenancy conditions, we may ask for immediate possession and evict you from your home.
The court cannot give us permission to evict a secure tenant except on one or more of the grounds set out in the Housing Act 1985. Full details of these grounds are given in your tenancy agreement.
Please ensure that you comply with your tenancy conditions at all times. We do not wish to evict people from their homes but will do so if it becomes necessary and if the court agrees.
