Anti-social Behaviour Injunctions

       

 

What are they?

An injunction is a civil order obtained from the county court that can control and remedy anti-social behaviour.

An injuction made by the court can compel an adult over the age of 18 to do something and / or prevent a particular action or behaviour.

An injuction can be applied for against tenants, owner occupiers and non-tenants where conduct "is capable of causing nuisance or annoyance to any person" and directly or indirectly relates to or affects housing management functions of Gloucester City Homes.

In serious cases where there have been threats of violence, actual violence or significant risk of harm, the defendent can be excluded from a specified area.

If an injuction is breached it is dealt with by way of civil proceedings and if this is proven the court can impose a fine or commit the defendent to prison.

 

When should they be used?

When someone is committing anti-social behaviour, including noise nuisance, verbal abuse of staff, agents and / or tenants and neighbours, visitors causing nuisance to neighbours, untidy gardens, and threats of violence and actual violence.

When a swift resolution is necessary that can provide immediate protection and be used before a problem escalates.
