Repossession
Repossession is usually a last resort where all other non-legal and legal measures have failed to stop a tenant, leaseholder or shared owner from breaking the conditions of their tenancy or lease; or failed to stop them committing anti-social behavior.
Notice of repossession
Before going to court, Gloucester City Homes will always give notice to the tenant, leaseholder or shared owner of our intention to ask the court to give us back possession of your home:

Secure Tenants will always receive a Notice of Seeking Possession

Non-secure tenants will receive a Notice to Quit

Leaseholders or Shared Owners will receive a Notice of our intention to aks the court to revoke the lease.
Court

It is the court who ultimately decides whether to end a tenancy or lease, although they are guided by housing laws.
You can apply to the court for a suspension based on the fact that you now intend to comply with the conditions of your tenancy or lease.
If respossession is granted then you will be given time to gather your possessions and to make arrangements to move from your home.
You might be able to get help from the Council. They are obliged by law to consider the circumstances of people threatened with homelessness or are already homeless. However it is worth noting that if your actions have resulted in your own homelessness the Council may not be obliged to provide you with suitable alternative accommodation - they may only advise or assist you to find suitable alternative accommodation, probably in the private rented sector.
It is also worth noting that landlords frequently ask for references before taking on new tenants and if asked the Council and / or Gloucester City Homes may be obliged to divulge the reason for you losing your tenancy or lease. This could make it even more difficult for you to find a new home.
